Privacy Policy

1.1 · Data controller

EasySoftwareBayy, with registered office at 16 Rue des Pontonniers, 67000 Strasbourg, France, is the controller of personal data processed through this website and our service engagements. Privacy correspondence may be directed to [email protected].

1.2 · Data we collect

When you submit an inquiry through our contact form, we collect your name, work email, phone number, company name, the service module you selected, and the content of your message. During active engagements we additionally process billing details, contract records, and technical logs necessary to deliver contracted services.

1.3 · Purposes and legal bases

Inquiry data is processed to respond to your request and prepare a proposal (Article 6(1)(b) GDPR — pre-contractual steps). Contract data is processed to perform our agreement and meet accounting obligations (Article 6(1)(b) and 6(1)(c) GDPR). Optional analytics cookies are processed only with your consent (Article 6(1)(a) GDPR). We rely on legitimate interests (Article 6(1)(f)) for service security and abuse prevention.

1.4 · Retention

Unsuccessful inquiry records are retained for a maximum of 24 months after the last contact. Client contract and accounting records are retained for the statutory periods required by French law (typically 10 years for commercial and accounting documents). Technical security logs are retained for no longer than 12 months.

1.5 · Recipients and transfers

Data is accessible only to authorized EasySoftwareBayy personnel and to processors hosting our email, form, and infrastructure services within the European Union. We do not sell, rent, or disclose personal data to advertisers or data brokers. Where a processor is established outside the EEA, transfers rely on Standard Contractual Clauses and equivalent safeguards.

1.6 · Your rights

Under the GDPR you may request access, rectification, erasure, restriction of processing, data portability, and objection to processing based on legitimate interests. Where processing rests on consent, you may withdraw it at any time without affecting prior lawful processing. You may lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL), the French supervisory authority. Requests may be sent to [email protected] and are answered within one month.

Art. 02

Terms of Service

2.1 · Scope

These terms govern API design, integration engineering, data pipeline, and related consultancy services provided by EasySoftwareBayy to its clients. Specific deliverables, timelines, and fees are defined in a written Statement of Work (SOW) signed by both parties; the SOW prevails over these general terms where the two differ.

2.2 · Engagements and fees

Engagements commence upon written acceptance of a proposal or SOW. Fees are quoted in euros or United States dollars as stated in the proposal and are payable according to the milestone schedule defined therein. Invoices are due within 14 calendar days unless otherwise agreed. Late payments accrue interest at the French statutory rate plus administrative costs.

2.3 · Client responsibilities

The client shall provide timely access to systems, credentials, documentation, and decision-makers necessary for delivery. Delays in client-provided inputs may extend delivery timelines on a day-for-day basis. The client is responsible for the accuracy and lawfulness of data processed through delivered integrations.

2.4 · Intellectual property

Upon full payment of all fees due under an SOW, EasySoftwareBayy assigns to the client all worldwide intellectual property rights in the client-specific deliverables, including source code, configuration, and documentation created under that SOW. Pre-existing frameworks, libraries, and tooling remain the property of EasySoftwareBayy and are licensed to the client on a perpetual, non-exclusive basis as necessary to use the deliverables.

2.5 · Warranties and liability

Deliverables are warranted to conform materially to the agreed SOW for 30 days following acceptance; during this period, material defects will be remedied at no charge. Except as expressly stated, services are provided without other warranties, whether express or implied. To the maximum extent permitted by law, EasySoftwareBayy's aggregate liability under any SOW is limited to the total fees paid by the client under that SOW in the twelve months preceding the claim. Neither party is liable for indirect or consequential damages.

2.6 · Confidentiality

Each party shall protect the other's confidential information with at least the care it uses for its own, and shall not disclose it to third parties except to personnel and processors bound by equivalent obligations. Confidentiality obligations survive termination for five years.

2.7 · Term and termination

Either party may terminate an SOW for material breach that remains uncured 15 days after written notice. Upon termination, the client shall pay for all work performed up to the termination date. Retainer agreements may be cancelled by either party with 30 days' written notice.

2.8 · Governing law

These terms are governed by French law. Disputes shall first be submitted to good-faith negotiation; failing resolution within 30 days, the competent courts of Strasbourg, France shall have exclusive jurisdiction, without prejudice to mandatory consumer protections.

Cookie Policy

3.1 · What cookies are

Cookies and similar technologies are small text files or local storage entries placed on your device when you visit a website. They allow the site to remember your actions and preferences over a period of time.

3.2 · Cookies we use

Strictly necessary. We store your cookie-consent decision in your browser's local storage (cookie_accepted) so the consent banner does not reappear on every visit. This entry is required for the site to function as you have configured it and does not track you across other websites.

Functional. Session state required to display forms and navigate securely may set first-party cookies where technically necessary.

Analytics. If we enable privacy-respecting, aggregated traffic measurement in the future, it will be loaded only after explicit consent, and this policy will be updated accordingly.

3.3 · Managing your preferences

You may clear or block cookies through your browser settings at any time. Blocking strictly necessary storage may cause the consent banner to reappear and may affect some interactive features. Most browsers also allow you to delete local storage entries individually under privacy or developer tools settings.

3.4 · Third-party content

Our contact page embeds a Google Map. Loading the map may cause Google to set cookies on your device under Google's own cookie policies. The map is displayed for location context; you may avoid loading it by contacting us directly at [email protected].

3.5 · Updates

Art. 04

Refund Policy

4.1 · Nature of our services

EasySoftwareBayy delivers digital engineering services — API development, integrations, and data pipelines. Fees compensate specialist time, design work, and deliverables defined in each Statement of Work, and are structured around milestones or monthly retainers.

4.2 · Right of withdrawal (EU consumers)

If you are a consumer within the meaning of French consumer law, you have a 14-day right of withdrawal from the conclusion of a distance contract, without giving reasons. Where a service has been expressly requested to begin before the end of the withdrawal period, you remain liable for the amount proportionate to what has been supplied up to the moment you inform us of your withdrawal. To exercise this right, notify us at [email protected] within 14 days of contract conclusion.

4.3 · Milestone engagements

For milestone-based projects, completed milestones are non-refundable once accepted. If a project is cancelled before acceptance of the next milestone, the cancelled milestone is not invoiced, and any prepaid amount for unstarted work is refunded within 14 days. Deliverables that materially fail to meet the agreed SOW specifications will be remedied at no charge under the 30-day warranty described in the Terms of Service; if remedy is impossible, the affected milestone fee is refunded in full.

4.4 · Retainers

Monthly observability and SLA retainers may be cancelled with 30 days' written notice. Any prepaid amount covering days after the cancellation effective date is refunded on a pro-rata basis. Hours already consumed within a retainer period are not refundable.

4.5 · How to request a refund

Send a refund request to [email protected] with your contract reference, a brief description of the issue, and — where applicable — evidence that the deliverable does not conform to the SOW. We acknowledge requests within 3 business days and process approved refunds to the original payment method within 14 calendar days of approval. Payment processing via our Stripe checkout follows the same timeline from our side; bank posting times may vary.
